Distance Sales Agreement

This agreement governs the sale and performance of the flight package (travel service) purchased by the Buyer electronically through suso.travel, and the rights and obligations of the parties, in accordance with the Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation.

3. Service Details

The service that is the subject of this agreement is the flight package described below:

Important: The underlying airline ticket is issued by Suso's contracted TURSAB-licensed travel agency. The agency's identity is determined at the time of purchase and communicated to the Buyer with the PNR delivery email.

Payment is collected through Suso's contracted payment service provider (PSP) using the method selected by the Buyer. If deferred payment is selected, the first installment is collected 30 days after the flight package is issued; subsequent installments are collected monthly.

5. Performance

Suso, following collection of payment, arranges for the airline ticket to be issued by the contracted agency within a reasonable time and delivers the PNR and e-ticket details to the email address provided by the Buyer. During performance, the Buyer's contact details (email, phone) are not used by Suso in correspondence with the agency on the Buyer's behalf; the agency-side ticket issuance process is conducted using Suso's own contact details.

6. Right of Withdrawal

6.1. Under Article 15 of the Turkish Distance Contracts Regulation, "passenger transport contracts" and "contracts for accommodation, transport of goods, car rental, food and beverage supply, and leisure or recreational services" are listed among the exclusions to the right of withdrawal. Exercise of the right of withdrawal over the underlying airline ticket may therefore fall within this exclusion.

6.2. Notwithstanding the above, Suso grants the Buyer the following good-faith flexibility:

Where the right of withdrawal is exercisable, the Buyer notifies [email protected] in writing prior to the issuance of the flight package. Refunds are processed using the original payment method within 14 days at the latest.

8. Suso-Side Cancellation

If, after payment is collected, Suso is unable to issue the flight package due to technical or operational reasons, Suso notifies the Buyer immediately and refunds the full amount within 7 business days.

9. Airline- or Agency-Side Changes

In the case of airline-side cancellations, delays or schedule changes, processing follows the rules of the airline and the agency. Suso assists the Buyer in pursuing rights against the airline or agency, but refunds and reissuance are subject to the airline's rules.

10. Force Majeure

Extraordinary events outside the parties' reasonable control (war, epidemic, natural disaster, public authority decisions, air traffic control disruptions etc.) are deemed force majeure. The parties are not liable for non-performance attributable to force majeure.

11. Jurisdiction

Disputes arising from this agreement are subject to the jurisdiction of Turkish Consumer Arbitration Committees within applicable monetary thresholds, and Turkish Consumer Courts above those thresholds.

12. Effectiveness

By electronic confirmation on suso.travel, the Buyer declares having read, understood and accepted all provisions of this agreement. The agreement enters into force at the moment of electronic confirmation and ends upon performance of the parties' obligations.
